Every recurring test (WKP) must contain proper documenta-tion in order to document a test and its scope as a whole.

Occupational Safety and Health Act (ArbSchG)

The labeling of tests is not mentioned verbatim in the Occupational Safety and Health Act. However, the law basically regulates all occupational safety issues and should not be omitted from this overview. The Occupational Safety and Health Act primarily regulates the health and safety of employees at work. The aim is to always guarantee and improve the safety of employees. For this purpose, the ArbSchG contains numerous measures and basic obligations for employers and entrepreneurs.

In principle, the employer must ensure that the employees are not exposed to any mortal danger or risks to their physical or mental health. Dangers must be fought and the technology used must be up to date. The protective equipment must also be available and the employees must be comprehensively instructed and trained.

To what extent and to what extent all these precautions must be taken depends on the individual risk assessment of the company. The employer thus decides which protective measures are to be taken depending on the existing risk potential. He is obliged to keep records of all decision-relevant data.

Industrial Safety Ordinance

The Industrial Safety Ordinance regulates the provision, use and monitoring of work equipment. Like the Occupational Safety and Health Act, it is aimed at employers. The Industrial Safety Ordinance is specified in the technical rules for industrial safety and applies to all systems, machines, devices and tools that require monitoring.

On the subject of documentation, the BetrSichV stipulates that all measures for testing, maintenance and repair must be recorded in writing and, if necessary, an inspection book should be kept. It must be possible to present this to the competent authority on request. For this purpose, test documentation should be kept for a certain period of time. A retention period of ten years is recommended. In this way, test results can be reproduced for a long time, results can be documented and changes can be observed.

Technical rules for operational safety

The technical rules for operational safety substantiate the industrial safety ordinance and provide helpful application information. If the employer adheres to the requirements, he can assume that all requirements of the BetrSichV are met.
The TRBS 1201 deals with the inspection of objects requiring surveillance. It defines the type, scope and frequency of the test. The regulation also specifies which requirements the examiner must meet and the form in which the exam is to be documented.
The contractor must instruct the auditor to keep appropriate records of the test results. In terms of content, the following information must not be missing:
  • Date of the test
  • Type of test (before first commissioning, recurring, after change)
  • Basics of the exam
  • Contents of the test (measurement method)
  • Result of the test (measured values)
  • List of the defects found
  • Instructions on how to proceed, repair, continued operation
  • Information on the tester (test results must be able to be assigned to the test item)
According to TRBS 1201, tests can also be recorded in an electronic system. A test sticker must also be affixed to the test item for complete control.


German statutory accident insurance

The information from the German Social Accident Insurance (DGUV) also contains information on labeling and documentation. An example is DGUV Information 208-032 or BGR 198/199

It is expressly stated that the result of the test is to be documented. In practice, a meaningful test report with measured values and measurement methods should be prepared. In this way, current and past test results can be compared very well. It is also possible to derive the safety-related history of the tested item. The test reports should therefore not only be kept until the next test, but for a longer period of time. The records for testing work equipment should contain at least the following information:
  • Data on the tested work equipment (manufacturer, type, serial number, etc.)
  • Location of the test item
  • Date of the test
  • Scope (legal basis) of the examination
  • Used measuring and testing devices
  • Result of the exam
  • Recommended test period (determination of the next test date)
  • Data on the examiner (name, commissioned company)
After the test has been completed, the DGUV Information recommends affixing a test sticker with the next test date. In this way, the user or the employee is also included in the checking process. The work equipment can be monitored with the test sticker and the next test date cannot be forgotten.

Various DIN standards also indicate that test results must be documented and marked. In terms of content, information such as the name of the tester and client, the type of test object, the results of all test steps and measurements, the date and the signature are required. The data obtained can be recorded by hand or digitally in the form of a test report. The affixing of a test sticker is also prescribed in some standards.

Legally secure documentation and labeling
The documentation and labeling of test results is addressed and stipulated by numerous regulations, laws and information documents. They are therefore important test steps for the control of work equipment. The employer or company should therefore always ensure that the documentation requirement is complied with.

Comprehensive records are an important safety consideration. By comparing the test protocols, changes can be noticed quickly. In this way, for example, expected damage can be prevented before it occurs. This ensures a safe condition of the work equipment and prevents accidents and injuries.

Another important reason for the documentation and labeling of checked objects is better monitoring. This means that the more comprehensible and accessible the state of a machine is, the more people monitor it. With test badges, employees can see when the last test took place or when the next one should be carried out. The probability of missing an examination date decreases.

If an accident occurs despite all the checks and safety tests, it is up to the company to prove its “innocence”. If detailed test protocols can be presented in this situation, the duty of care has to be observed and the correct procedure of the company has to be proven.
