Ordinance on safety and health protection when using work equipment

On June 1, 2015, the amended Ordinance on Industrial Safety and Health (BetrSichV) comes into force. For employers, this means a new chapter in terms of occupational safety. The new regulation brings with it numerous changes - in terms of inspection obligations and responsibilities as well as documentation in the company.

The new BetrSichV is based on the European regulations. What has changed since June 1, 2015 is briefly summarized here.

  • The documentation and the documents may in future also be archived purely electronically.
  • Dangerous situations with potential for accidents, such as maintenance, special operating conditions, malfunctions and manipulations, are now specifically addressed.
  • The ordinance contains clear guidelines for reducing ergonomic and psychological stress in the workplace.
  • Operators of systems that require monitoring must observe new requirements for the operating permit and the prescribed tests.
  • Violations of the inspection and due diligence obligations of the BetrSichV will in future be considered administrative offenses and can be prosecuted.
